Terms of service


These Terms of Service (“Terms”) apply to your use of pearler.com.au (the “Site”) and any purchase you make from Pearler Australia Pty Ltd (“Pearler”, “we”, “us”). By using the Site or placing an order, you agree to these Terms. Please read them along with our Refund Policy, Shipping Policy and Privacy Policy, which form part of these Terms.

1. Using the Site

  • You must be at least 18, or have a parent or guardian’s permission, to place an order.
  • You agree to give accurate information when you order and to keep your account details secure.
  • You must not misuse the Site, including by attempting to access it without authorisation, interfering with how it works, or using it for anything unlawful.

2. Our products

  • We make every effort to show our products, colours and sizing accurately. Colours may look slightly different depending on your screen.
  • Pearler socks are made to an exact shoe size. It’s your responsibility to choose the right size, but if it isn’t right, you can exchange it under our Refund Policy.
  • All products are subject to availability. We may limit quantities or discontinue products at any time.

3. Prices and set pricing

  • All prices are in Australian dollars (AUD) and include GST.
  • Set pricing applies automatically in your cart when you buy multiple eligible pairs. Any combination of sizes, lengths and thicknesses counts toward a set tier.
  • Set pricing can’t be combined with other discount codes unless we say so.
  • If a pricing error appears on the Site, we may cancel any order placed at the incorrect price. If you’ve been charged, we’ll refund you in full.
  • We may change prices at any time, but changes won’t affect orders we’ve already confirmed.

4. Promotions and free gifts

  • Free gift offers, such as the free Wash Bag on orders of $74 or more, apply automatically while stocks last and are limited to one per order.
  • We may change or end any promotion at any time without notice.
  • Free gifts have no cash value and can’t be exchanged for cash or other products.
  • If you return items and your order no longer meets an offer’s threshold, the refund may be adjusted as set out in our Refund Policy.
  • Discount codes are limited to one per order unless stated otherwise, can’t be applied to past orders, and may have their own conditions.

5. Orders and payment

  • Placing an order is an offer to buy. We accept your order when we send your order confirmation email.
  • We may refuse or cancel an order, for example if a product is unavailable, we suspect fraud, or there’s an error in the price or description. If we cancel, we’ll refund any payment in full.
  • Payment is processed securely through Shopify and our payment providers. We don’t store your full card details.

6. Shipping

  • We currently ship within Australia only.
  • Standard: free on orders of $99 or more, otherwise $12. Delivery takes 2 to 8 business days.
  • Express: $16, delivery in 1 to 4 business days.
  • Orders are dispatched from Melbourne. Delivery times are estimates and may be affected by carrier delays outside our control.
  • Risk in the products passes to you on delivery. Please check your address carefully at checkout. We aren’t responsible for orders delivered to an incorrect address you provided.
  • If your order includes a pre-order item, we’ll ship everything together once all items are ready.

7. Returns, exchanges and refunds

  • You have 30 days from delivery to request a return or exchange. See our Refund Policy for full details.
  • For hygiene reasons, we can’t accept worn or washed socks unless they’re faulty.

8. Australian Consumer Law
Our products come with guarantees that can’t be excluded under the Australian Consumer Law. You’re entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You’re also entitled to have products repaired or replaced if they fail to be of acceptable quality and the failure doesn’t amount to a major failure. Nothing in these Terms limits your rights under the Australian Consumer Law.

9. Intellectual property
All content on the Site, including the Pearler name and logo, product names, designs, photos, videos and text, belongs to Pearler or our licensors. You may not copy, reproduce or use any of it without our written permission.

10. Reviews and content you share
If you submit a review, photo, comment or other content, or tag us on social media, you give us permission to use it on our Site and marketing, without payment. You confirm that your content is your own, is accurate, and doesn’t break any law or anyone else’s rights. We may remove any content at our discretion.

11. Third-party links
The Site may link to other websites. We’re not responsible for their content or how they handle your information.

12. Limitation of liability
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability for any claim relating to a product is limited to replacing the product, supplying an equivalent product, or refunding the price you paid. We aren’t liable for indirect or consequential loss.

13. Privacy
We handle your personal information in line with our Privacy Policy.

14. Changes to these Terms
We may update these Terms from time to time. The version on the Site at the time you place your order applies to that order.

15. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the jurisdiction of the courts of Victoria.
